This Privacy Policy explains how information about you is collected, used, and disclosed by Affinity Express, Inc. (“Affinity Express”). Affinity Express makes communication tools used by our business customers (each, a “Customer”) to communicate with their customers (“End User”), and so this Privacy Policy applies to information we collect when End Users use products, services, websites, apps that our Customers make available when using our services (“Customers Services”). Additionally, it applies to information we collect from End Users and Customers when they access or use our websites, chatbots or similar services (collectively, “Sites”) and it also applies to Customers that use and access our mobile applications, cloud services, and/or any other Affinity Express products and services (collectively, the “Services”).

Your use of the Services and the Sites indicates to us that you have read and accept our privacy practices, as outlined in this privacy statement. If you have any questions or concerns regarding this privacy statement, please contact: Infosec@affinityx.com.

We may change this Privacy Policy from time-to-time. Please review the Privacy Policy from time to time so that you can stay informed about the information we collect and how we use it.


OUR SERVICES

Customers subscribing to our Services can, among using other features, interact with our chatbots, send/receive SMS,  Facebook Messages, and other types of messages to and from their customers, potential customers, vendors, and/or other persons. Affinity Express also provides enhanced voicemail services where Affinity Express can record and transcribe voicemail messages and then respond by sending the caller a text message. Additionally, Affinity Express uses artificial intelligence to process content in messages so that we, for example, can automatically handle an appointment request, or route messages to the appropriate employees, or otherwise automatically respond to messages sent to its Customers.

When an End User interacts with a Customer – using a chatbot on website or any other online channel, by sending a text, leaving a voicemail, submitting a request in-person or via their website or app, for example – an End User may provide information, including personally identifiable information, and it will provide some or all such information to us so that a message can be sent to our Customer. Without access to the information an End User provide to our Customers, we cannot provide our Services, which in turn allows our Customers to provide the Services to an End User. Both the Customer’s privacy policy and Affinity Express’s Privacy Policy will apply since we both have access to the information that an End User shared.

Additionally, Affinity Express’s Privacy Policy also covers any information that we may collect from Customers, including but not limited to their respective employees, agents, independent contractors and/or anyone else that they authorize to use the Services (“Personnel”).

Information Collected

Information We Collect or Receive

Individual User Data. If you are an End User, we collect information in a variety of ways, including when you provide information directly to us and/or when we receive information that you provide to Customers. As an example, when you use and/or interact with Customer Services, you may provide information, such as your name, company name, email address, and phone number, as well as other information that you otherwise choose to provide. You may, for example, send and/or receive text messages, other types of messages and/or voicemails, and when you do, we collect your telephone number and the content in any messages you send/receive. For clarity, when we provide our Services to a Customer, we will receive the same or similar type of personal information that the Customer receives and which we need to provide our Services to the Customer.

If you are a Customer, you will need to provide contact information for your Personnel who you authorize to access and use our Services. That information may include and is not limited to name, company name, titles, job-related information, address, email address, telephone number(s) and passwords used to log into our Services. We also collect the texts, other types of messages and/or voice mail messages that Customers/Personnel send/receive using our Services.

Device and Usage Data. For End Users and Customers, we may collect and/or receive information about the computer and/or mobile device you use when you access Customer Services and our Services, respectively. This information may include (and is not limited to) hardware model, operating system and version, unique device identifiers and network information, device type, model and manufacturer, and mobile device operating system brand and model. For End Users, we will collect/receive information related to your telephone calls, text messages, other types of messages and voicemails sent to and from the Customer. Similarly, we collect the same type of information from Customers using our Services. For End Users and Customers, we collect log information about your use of the Customer Services/our Services, respectively, including the type of browser you use, when you access such services, pages viewed, your IP address and the web pages you visit before and after navigating to a different webpage.

Cookies are required for us to provide our Services. A cookie is a small amount of data, which often includes an anonymous unique identifier that is sent to your browser from a web site’s computers and stored on your computer’s hard drive. We use cookies to record session information, and we use permanent cookies.

We use analytics software to improve the functionality of our Services. This software allows us to collect and record data about how our apps and Sites are used, how often webpages are accessed, other usage data, and performance data, among other data. Standing alone, this information is not personal information and we do not link it to any personal information.

For End Users contacting a Customer and/or using the Customer Services, you are not required to, but you may voluntarily choose to send a message that includes sensitive information, such as health, health insurance and any other personal information or preferences that you are sensitive to (“Self-Reported Information”). Affinity Express does not require any Self-Reported Information to provide its Services and we may not know when you may include such data/information in messages sent to the Customer, and thereby to Affinity Express. Similarly, Customers/Personnel are not required to provide Self-Reported Information to Affinity Express. To the extent as End User or Personnel, if you  voluntarily provide such information, you are making such data or information public, and Business Customers and Affinity Express will have access to, use, transport, and store such information to provision and maintain their respective services.

Information We Receive from Other Sources

For End Users, we may provide various features or services that require us to interact with third party service providers so that the Customer can respond to an End User’s requests. For example, to fulfill a scheduling requests that you make, or to process a modification of a pending appointment with a Customer – we will interact with and receive information from third party apps and/or services to the extent necessary to respond to your request.

We may also obtain information from our Customers and third parties, including but not limited to identity verification services and publicly-available sources. We may combine that information with information we collect through our Services. In such cases, this Privacy Policy governs our use and disclosure of such information.

For End Users, if you create or log into your account through a social media site to access/use a Customer Service, then we will have access to certain information from that site, including but not limited to your name, and other account information, in accordance with the authorization procedures determined by that social media site.

Use of Information

We use your personally identifiable information to provide you with the Services, including information or content that you have requested and, in some cases, to contact you about Affinity Express programs, products, features or services. If you no longer wish to receive marketing communications from us, you may send us an email to marketing@affinityx.com.

Affinity Express uses non-identifying information collected on our website in the aggregate to better understand your use of the website and to enhance your experience. For example, we may use the information to improve the design and content of our website.

We may employ other companies and individuals to perform functions on our behalf. Affinity Express employees, agents and contractors who have access to personally identifiable information are required to protect the information in a manner that is consistent with this privacy statement.

We may provide access to your personally identifiable information when legally required to do so, to cooperate with police investigations or other legal proceedings, to protect against misuse or unauthorized use of our website, to limit our legal liability and protect our rights, or to protect the rights and safety of visitors to this website or the public. In those instances, the information is provided only for that limited purpose.

We will not share your personally identifiable information in ways unrelated to those described above without providing you with an opportunity to opt out of such use or otherwise prohibit such unrelated uses. Affinity Express will not rent or sell your personally identifiable information.


SHARING AND TRANSFER OF INFORMATION

We share personal information that we collect about those that use the Customer Services and/or Services as follows, and as otherwise described in this Privacy Policy:

  • Service providers.With vendors, consultants, other service providers and telecom carriers who need access to such information to carry out work on our behalf and/or in order to provide ours Services to Customers.
  • Certain Requests.In response to a request for information, if we believe disclosure is in accordance with any applicable law, regulation or legal process, or as otherwise required by any applicable law, rule or regulation. Similarly, if we believe it is reasonable to do so to protect the rights, property and safety of Affinity Express or others;
  • Business Transactions.In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company; and
  • Your Consent.With your consent or at your direction, including if notice is provided through either the Customer Services and/or our Services that the information you provide will be shared in a particular manner and you provide such information.

We do not sell, share, or rent any personal information to third parties in any ways different from what is disclosed in this Privacy Policy. However, we may share with third parties non-personal information, aggregated information or other anonymized data which cannot reasonably be used to identify you.

Modifying Information

If you visit our website and volunteer personally identifiable information, you may modify, update or delete such information by sending us an email at marketing@affinityx.com You should be aware, however, that it is not always possible to completely remove or modify information in our databases. In addition, please be aware that your ability to opt out from receiving marketing and promotional materials does not change our right to contact you regarding your use of our website.

Protections for Children

Protecting children’s privacy is important to Affinity Express. For that reason, we do not collect or maintain information on our website from those we actually know are under the age of 13, nor is any part of our website design to attract anyone under 13. We request that all visitors to our website who are under 13 not disclose or provide any personally identifiable information. If we discover that a child under 13 has provided us with personally identifiable information, we will delete that child’s personally identifiable information from our records.

Data Security

Affinity Express takes reasonable steps to maintain the security of the personally identifiable information that we collect, including limiting the number of people who have physical access to our database servers, as well as installing electronic security systems that guard against unauthorized access. However, no data transmission over the Internet can be guaranteed to be completely secure. Accordingly, we cannot ensure or warrant the security of any information that you transmit to us, so you do so at your own risk.

Consent to Transfer

This website is operated in the United States. If you are located outside of the United States, please be aware that any information you provide to Affinity Express could be transferred outside the United States. By using the Sites, participating in any of our Services or Customer Services and/or providing us with your information, you consent to this transfer.

Please be aware that Affinity Express is not responsible for the privacy practices of any third-party sites. Therefore, we encourage our users to read the privacy statement of each and every website that collects personally identifiable information. Breach Notification

Any person handling Affinity Express personal data has a responsibility to report any data privacy breach related incidents in case of violation of the data protection policy to infosec@affinityx.com.
